Overview
Welcome to PickyTails. Throughout these Terms, "we," "us," and "our" refer to PickyTails. We operate this online store and website, including all related content, features, tools, products, and services (together, the "Services"). PickyTails is powered by Shopify, which provides the underlying technology that allows us to offer these Services to you.
These Terms of Service, along with any policies referenced within them (collectively, the "Terms"), describe your rights and responsibilities when using the Services.

By visiting, browsing, or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you should not use or access the Services.

You are responsible for keeping your account credentials secure and for any activity that takes place under your account. Accounts may not be transferred, sold, assigned, or licensed to anyone else.

We do our best to display our products accurately on the Services. That said, the appearance of products — including colors, finishes, and dimensions — may look slightly different on your screen depending on your device, monitor settings, and other display factors.
We do not warrant that the appearance, feel, or quality of any product will exactly match what is shown in our online store, or that it will meet every personal expectation.
Product descriptions, availability, and offerings may change at any time without notice. We reserve the right to discontinue any product, and we may also limit the quantities of products available to specific people, regions, or jurisdictions on a case-by-case basis.
Section 3 — Orders
Placing an order through the Services is considered an offer to purchase. PickyTails reserves the right to accept or decline any order at our discretion. An order is not considered accepted until we confirm it, and we must receive and successfully process payment before that confirmation is issued.
Please review your order carefully before submitting, since cancellation requests cannot always be accommodated once the order has been accepted. If we are unable to accept, fulfill, or modify an order — or if we cancel one — we will attempt to reach you using the email, billing address, or phone number provided at checkout.
All purchases are subject to return or exchange in accordance with our Return & Refund Policy.
By placing an order, you confirm that your purchases are intended for personal or household use, not for commercial resale or export.
Section 4 — Pricing, Payment, and Billing
Prices, promotions, and discounts displayed on the Services are subject to change without notice. The price applied to your order is the price displayed at the time the order is placed, and that price will appear on your order confirmation email. Unless we say otherwise, posted prices do not include taxes, shipping, handling, customs, or import fees.
Prices on PickyTails may differ from prices offered through other retailers, marketplaces, or platforms. From time to time, we may run promotions governed by their own separate terms; if those terms conflict with these Terms, the promotion-specific terms will apply.
You agree to provide accurate and complete payment, billing, and account information at checkout, and to keep that information up to date — including email address, payment card numbers, and expiration dates — so we can process orders and reach you when needed.
By submitting payment information, you represent and warrant that (i) the payment details you provide are accurate, current, and complete; (ii) you are authorized to use the payment method submitted; (iii) the charges will be honored by your card issuer or payment provider; and (iv) you will pay all charges incurred at the prices listed, including applicable shipping, handling, and taxes.
Section 5 — Shipping and Delivery
We are not liable for shipping or delivery delays. All delivery timeframes are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs processing, weather events, or other circumstances outside our control. Once an order is handed off to the carrier, title and risk of loss transfer to you.

Section 6 — Intellectual Property
The Services — including all trademarks, logos, brand elements, text, images, graphics, video, audio, product reviews, and the overall design, layout, and arrangement of the site — are owned by PickyTails, our affiliates, or our licensors. This content is protected by U.S. and international copyright, trademark, patent, and other intellectual property laws.
These Terms grant you a limited license to use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from the Services without our prior written permission. Nothing in these Terms grants you any license or rights to the intellectual property of PickyTails, Shopify, or any third party except as explicitly stated. Unauthorized use may violate intellectual property laws. All rights not expressly granted in these Terms are reserved.
The PickyTails name, logo, product names, designs, and slogans are trademarks of PickyTails or our affiliates. You may not use these trademarks without prior written permission. Shopify's name, logo, designs, and product names are trademarks of Shopify. All other trademarks displayed on the Services belong to their respective owners.
Section 7 — Optional Third-Party Tools
The Services may give you access to optional tools provided by third parties. We do not monitor, control, or have any input over these tools.
You acknowledge that any third-party tools made available through the Services are provided "as is" and "as available," with no warranties, representations, or endorsements of any kind. We are not liable for anything related to your use of these tools, and any use is entirely at your own risk. We recommend reviewing the terms and policies of any third-party provider before using their tools.
We may, in the future, introduce new tools, features, or resources through the Services. Any new feature added to the Services will also be subject to these Terms.

The Services may contain links to, or embedded content from, websites operated by third parties. We are not responsible for reviewing, evaluating, or guaranteeing the accuracy of any third-party content or websites you choose to access through these links.
If you decide to leave the Services to visit a third-party site, you do so at your own risk. We are not liable for any damages, losses, or issues that arise from your interaction with third-party websites or your purchase of products or services through them. Any complaints, concerns, or questions about a third-party site or product should be directed to that third party.
Section 9 — Relationship With Shopify
PickyTails is powered by Shopify, which enables us to operate this store and provide the Services. However, all sales and purchases through PickyTails are made directly between you and PickyTails — not Shopify.
By using the Services, you acknowledge that Shopify is not responsible for any aspect of the transactions between you and PickyTails, including any injury, damage, or loss arising from products or services purchased. You release Shopify and its affiliates from any claims, liabilities, or damages connected to your purchases or interactions with PickyTails.
Section 10 — Privacy
Any personal information collected through the Services is handled in accordance with our Privacy Policy, which you can view here. Some personal information may also be subject to Shopify's Privacy Policy, available on Shopify's website. By using the Services, you confirm that you have read and understood these privacy policies.
Because the Services are hosted by Shopify, Shopify collects and processes information about your interactions with the Services in order to operate and improve the platform. The information you submit may be transferred to Shopify and to service providers in countries other than your own. For more details, please review our Privacy Policy.
Section 11 — Feedback and Submissions

You agree that your Feedback will not violate the rights of any third party, including copyright, trademark, privacy, or other personal or proprietary rights. You further agree that your Feedback will not contain unlawful or abusive content, or contain any virus or other harmful code that could affect the operation of the Services or any related website. You may not submit Feedback under a false email address, impersonate any other person, or otherwise mislead us or third parties as to the origin of any Feedback. You are solely responsible for the Feedback you submit and its accuracy. We take no responsibility and assume no liability for any Feedback posted by you or any third party.

The Services may occasionally contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping charges, transit times, or availability. In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code that may affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, sell, resell, or otherwise exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, pretext, spider, crawl, or scrape; or (e) interfere with or circumvent the security features of the Services or any related website, other websites, or the Internet. We reserve the right to suspend, disable, or terminate your access to the Services at any time, without notice, if we determine that you have violated any part of these Terms.

We may terminate this agreement or your access to the Services at our sole discretion, at any time, and without notice. You will remain responsible for any amounts owed up to and including the date of termination.
The following sections will remain in effect after any termination: Intellectual Property, Feedback and Submissions, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy, and any other section that by its nature should continue after termination.

We do not warrant the accuracy, completeness, or usefulness of any information presented, and any reliance on it is at your own risk. THIS INCLUDES, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO PORTIONS OF THIS DISCLAIMER MAY NOT APPLY TO YOU.
Section 16 — Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PICKYTAILS, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS — AS WELL AS THOSE OF SHOPIFY AND ITS AFFILIATES — SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND. THIS INCLUDES, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS OBTAINED THROUGH THEM. THIS APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Section 17 — Indemnification
You agree to indemnify, defend, and hold harmless PickyTails, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims — including reasonable attorneys' fees — brought by any third party arising out of:
Your breach of these Terms or the documents referenced within them;
Your violation of any law or the rights of a third party; or
Your access to and use of the Services.
We will notify you of any indemnifiable claim, though a delay in notice will not affect your obligations unless it materially prejudices your defense. We may take control of the defense and settlement of such claims at your expense, including selecting counsel, but we will not settle any claim that requires non-monetary obligations from you without your consent (which will not be unreasonably withheld). You agree to cooperate in the defense of any indemnified claims, including by providing documents we reasonably request.
Section 18 — Severability
If any part of these Terms is found to be unlawful, void, or unenforceable, that part will still be enforced to the fullest extent permitted by applicable law, and the unenforceable portion will be considered severed from these Terms. The remaining provisions will continue in full force and effect.
Section 19 — Waiver and Entire Agreement
Our failure to exercise or enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
These Terms, together with any policies posted on the Services, represent the entire agreement between you and PickyTails regarding your use of the Services. They replace any prior or contemporaneous agreements, communications, or proposals — whether written or oral — between you and us, including any earlier versions of these Terms.
Any ambiguity in these Terms will not be interpreted against the drafting party.
Section 20 — Assignment
You may not assign, delegate, or transfer this agreement, or any of your rights or obligations under it, without our prior written consent. Any attempt to do so will be void. We may transfer, assign, or delegate these Terms and our rights and obligations at any time, without notice or consent.
Section 21 — Governing Law
These Terms, and any separate agreements through which we provide Services to you, are governed by and interpreted under the federal and state laws applicable in the jurisdiction where PickyTails is headquartered. You and PickyTails agree to the personal jurisdiction and venue of those courts.

Section headings in these Terms are included for convenience only and do not affect the interpretation or scope of any provision.

We reserve the right to update, modify, or replace any part of these Terms at our sole discretion by posting changes on our website. It is your responsibility to check this page periodically for updates. Where required by law, we will provide notice of material changes, and any changes will become effective on the date specified in the notice. Your continued use of the Services after changes are posted constitutes your acceptance of those changes.
